DUNKESWELL PARISH COUNCIL

Minutes for a meeting of Dunkeswell Parish Council held in the Village Hall at 7pm,
Monday 14th December 2009.

Present:            Cllrs Mr G Sworder (Chairman), Mr J Barrow (Vice Chairman),Mrs V Keitch,
Mssrs M Stevens, C Sumpter, B Procter, A Luscombe, County Councillor Mr Paul Diviani,
District Councillor Mr Bob Buxton, PC Vickery 4783, and eight members of the public.

All councillors are politely reminded of their obligation to declare interests under the Code of Conduct.
In making decisions the Parish Council recognise their statutory duties provided for in Section 11A(2) of the National Parks and Access to the Countryside Act 1949 (National Parks) and Section 85 of the Countryside and Rights of Way Act 2000 (AONBs) that in exercising or performing any functions in relation to, or so as to affect, land, they shall have regard to their purposes (ie conserve and enhance their natural beauty, wildlife and cultural heritage and to promote opportunities for the understanding and enjoyment of their special qualities by the public).
           
1.1            Minutes of the previous meeting held in the Village Hall on Monday 16th November 2009 were signed as a correct record of that meeting. AGREED.

2.1.1             09/1826/COU Brookside farm – permission granted for change of use from non-residential training unit to residential family unit. 2.4.1            09/2186/TRE 5 Walden Road – 13 beech trees reduce crowns by 3m, remove side branches where they encroach on neighbours trees, crown lift to 5m above ground level. Split decision: Permission granted to crown lift to give 4m clearance above garden, reduce by approximately 3.5m from growing tip: three 1st order branches growing from a height of 6m to the north west side of the canopy, one 1st order branch growing at a height of 7.5m on the north west side of the canopy and one 1st order branch growing at a height to 5.5m on the north side of the canopy. Permission refused to; reduce the crowns of 13 Beech trees by approximately 3m to lift the crowns by approximately 5m and to reove some side brances where they encroach on neighbours trees and remove deadwood. Boundary review – The Boundary Committee has made a recommendation to the Secretary of State that Devon has a single County Unitary Authority with no changes to the boundaries of Plymouth or Torbay.  ENVIRONMENT5.1        It was agreed that the SWW and the EA should be contacted in order to discuss the problems of overloaded sewers whenever there is excessive rain and constantly flooding manholes in the village. The first manhole at entrance to Highfield road, outside the old police house and then the last bungalow on Green lane and finally the manhole outside Marylea. Clerk to contact EA and SWW.COMMUNITY FACILITIES    Community policing report – PC Vickery – one crime since last meeting, the theft of an Ifor Williams trailer from a secure compound on the Airfield Industrial estate. Playgrounds/Sports field/ Allotments – the Multi use games area is nearly complete, the trees are now being felled and the replanting is planned. Mr Barrow handed in a cheque for £76 towards replanting from the Tree Council.  The fence is to be repaired and Mr Barrow will take the springs off the gates and modify the hinges to be self-closing.  The lease will now include the dog walking path, so the hedge will also need clearing.Halls – no report this time.Emergency Plan –http://www.devon.gov.uk/model_plan.pdf Mr Jones will bring a completed draft to the parish plan meeting in January – Clerk has asked the question on insurance of volunteers and awaits a response.Proposed Bus Shelter Manleys Lane – clerk is obtaining quotesFINANCE          7.1        Rising to the challenge South West Associations of Local Councils conference – 10am – 4pm Monday 8th February 2010 Tiverton - £40 per person – it was agreed that this was too expensive to warrant sending any representatives.7.2            Receipts -                     Tree Council for replanting on Sportsfield                    £76.00

Power of Well-being Cllr Luscombe and Cllr Keitch attended a training session recently at Luppitt Village Hall.  As the Council now have 80% or more of councillors trained in the use of the Power of Well-being, a qualified clerk, more that two thirds of seats were filled at the last election and have published a statement of community engagement, it is proposed a resolution be passed determining eligibility. This will then remain in effect until the day before the annual meeting after the next elections when the council must again determine its eligibility.

It was also agreed that Dunkeswell would pay for the two places for Luppitt councillors at the Honiton Training in lieu of paying Luppitt for sending two councillors to their training for ease of invoicing.
