DUNKESWELL PARISH COUNCIL

Minutes for a Meeting of Dunkeswell Parish Council held in the Village Hall at 7.30pm, Monday 16th February 2009.

Present:            Cllrs Mr G Sworder (Chairman), Mr J Barrow (Vice Chairman), Cllrs Mrs B Russell and Mrs V Keitch, Mssrs M Stevens, B Procter, A Luscombe, District Councillor Mr Bob Buxton, PC Vickery 4783, and two members of the public.

All councillors are politely reminded of their obligation to declare interests under the Code of Conduct.
In making decisions the Parish Council recognise their statutory duties provided for in Section 11A(2) of the National Parks and Access to the Countryside Act 1949 (National Parks) and Section 85 of the Countryside and Rights of Way Act 2000 (AONBs) that in exercising or performing any functions in relation to, or so as to affect, land, they shall have regard to their purposes (ie conserve and enhance their natural beauty, wildlife and cultural heritage and to promote opportunities for the understanding and enjoyment of their special qualities by the public).
           
1            Minutes of the previous meeting held in the Village Hall on Monday 19th January 2009 were signed as a correct record of that meeting.  AGREED.

2            PLANNING

• Decisions (for information)

2.1.1            08/3185/LBC The Old Forge – permission refused for retention of replacement windows. The parish council were unhappy about this decision and the pressure it puts on the current owner to correct a work done over 10 years ago by a previous owner.

• Applications (for comment – support or objection)
• 09/0196/FUL Higher Musgrove Farm, Abbey – conversion of loft including dormer window, conversion of garage to kitchen with extension. Recommendation: The Parish Council SUPPORT this application
• 09/0036/FUL Highfield Collard Farm, Blackborough – erection of a 6kw wind turbine on a 15m tower. Recommendation: The Parish Council SUPPORT this application
• 09/0318/FUL Land adjoining Keitch on Dunkeswell Airfield – use of land for brick cutting and stationing of containers for self storage hire. For comment when plans are received.

2.3            Enforcement

• Rosemary Cottage – copy letter requesting application be submitted for garage and decking.  The Parish Council  had also received a complaint from a next door neighbour that water from a spring uncovered by this work is causing problems, it was suggested that this issue should be discussed with building control.
• Parish Plan Update is awaiting proposed funding from the Blackdown Hills Sustainable Development Fund.
• Appeals – APP/U1105/C/09/2093544 - Unit 2 Flightway – appeal lodged against Enforcement Notice to remove residential mobile home and storage containers on the grounds that the permission should be granted and that the time given to comply (6mths) is too short. Written representations to the planning inspectorate by 9th March 2009. 
• EDDC are taking Kart track case to appeal and the case will be reheard by another judge at a higher court.  The Smeatharpe case will then be heard pending the final decision.
• Government Unitary Authority decision has been delayed further until July.

• HIGHWAYS AND TRAFFIC 

3.1        Cllr Barrow asked Cllr Buxton to investigate water coming off the old show field at Langford Bridge.  Clerk to complain about road between Dunkeswell and Gypsy Cross, Langford Bridge to Windgate Hill and chase the Bridge department about the road edge in the old village.

• FOOTPATHS AND BRIDLEWAYS

4.1        Mr Barrow reported that the bridge has been put in on footpath 7 to a high standard by DCC footpaths. 

• ENVIRONMENT

DCC - Commons Act – Further to correspondence received in 2008 in which DCC served notice that they are now the Commons Registrations Authority for Devon (as part of a trial to test part 1 of the Commons Act 2006). An even is now being held with further information about the Act, and types of application that landowners and commoners can now make to the Commons Registration Authority. Village Greens will also be covered. The evening will be in March or April and they will also be attending the County Show to publicise the changes. RSVP 13th February 2009 using the attached form (final date will then be confirmed).

COMMUNITY FACILITIES   

Community policing report – PC Vickery/PCSO Anning – nine crimes – one sexual assault (man charged), two assaults at a care home and six criminal damages which may have been youngsters who’d been to a party.

Playgrounds/Sports field/ Allotments – More funds are being sought for equipment. Lease is still awaited.

Halls – no report this time

• Emergency Plan – Devon Primary Care Trust has written to the Parish Council explaining that government are predicting a pandemic flu as seen last in 1968, they anticipate half the population becoming infected during a fifteen week period, this may even carry an increased mortality rate than is usual with seasonal flu with secondary infections such as pneumonia. They are therefore urging parishes to write an emergency plan and publish this in case of an outbreak (see below for reminders on avoidance!). A model plan is available at http://www.devon.gov.uk/model_plan.pdf  agreed to be rolled in with the parish plan.
