Minutes for the Meeting of Dunkeswell Parish Council held in the Village Hall at 7.30pm on Monday 19th July, 2004.

Present: Mr G Sworder (Chairman), Mr A Guest (Vice Chairman), Mrs B Russell, Messrs J Barrow, C Sumpter,
M Stevens, B Procter, A Luscombe, PC Lea and 5 members of the public.
Apologies: District Councillor Mrs M Boote and County Councillor Mr B Nicholson

1 Minutes of the previous meeting held in the Village Hall on Monday 21st June, 2004 were signed as a correct record of that meeting. Proposed by Mr Barrow, seconded by Mr Luscombe and unanimously agreed.

Mr Sworder offered an update of definitions of relatives, friends and enemies within the Code of Conduct to councillors.

2 PLANNING
2.1 East Devon District Council (EDDC) Decisions - for information
04/P1242 Southhayes Farm - permission granted for garage.
04/P1078 Wolford Chapel - Permission granted for disabled access ramp.
04/P1293 Wolford Chapel - Permission granted for ramped access to the building
04/P0637 Dunkeswell Aerodrome - permission granted variation of time condition

Applications
2.2.1 04/P0078 British Light Aircraft Co. Ltd. - change of use - hangar from storage to assembly of aircraft/ extensions/alterations. Clerk to contact EDDC and check if any further information has been received.

2.2.2 04/P0484 Dunkeswell Kart Racing Club - formation of extended track. Amendment to plan received 5/3/04. Copy letter received from EDDC to Sheldon Parish Meeting confirming content of meeting on 21st May 2004 between Mrs Little (EDDC), Mrs Napier (Sheldon Parish Meeting), District Councillor Mrs Boote and Mr Sworder.
Mrs Little states that she will write to the Head of Health for advice, follow up an unauthorised use on 19th May 2004, check on new gateways and bollards and whether racing is stopping between 11-12 on Sundays. In addition, EDDC are to seek further information from applicants, legal advice, commission a noise expert, look at possibilities for negotiation with the applicant and then call another meeting to discuss the way forward.

2.2.3 04/P1221 WIMS (UK) Ltd., Culme Way - 30 residential units, parking, community facilities, extension to doctors surgery and pavilion. Mr Sworder has suggested that a district heating scheme be included in the proposal in addition to the previous comments returned. Further information still awaited.

2.2.4 04/P1325 WIMS (UK) Ltd. 5 units 19 & 19a, Flightway - replaces 03/P1984 23 industrial units (B1, B2, B8). Further information is awaited.

2.2.5 04/P1528 Mr Frost, 9 Powell's Way - Demolish one of two garages and build between the bungalow and the remaining garage. Returned with no objection prior to meeting due to EDDC time restrictions. Proposed by Mr Barrow, seconded by Mr Procter and unanimously agreed.

2.2.6 04/P1559 Sylvan Developments (South West Ltd.), Manley's Lane - erection of fence. Returned prior to meeting due to EDDC time restrictions with objection (as previously given) due to the height of the fence being in excess of that permitted beside a public highway. Proposed by Mr Barrow, seconded by Mr Procter and unanimously agreed.

2.2.7 04/PP1694 Mr Paradise, 4 Kennedy Way - conservatory. (Planning Committee to visit and make recommendation).

2.2.8 04/P1737 Mr Baker, Old Highwood Farm - new driveway for holiday let. Proposed for approval by Mr Barrow, seconded by Mr Guest and unanimously agreed.

2.2.9 04/P1744 NTL, Nr Slade Farm - installation of temporary generator. Proposed for approval by Mr Sumpter, seconded by Mr Barrow and unanimously agreed.

Letter of objection received re: application 04/P1504 Flightway - temporary permission compound offices/storage.

2.3 Appeals
Mr K Purkess, Storage and sale of caravans (further to refusal of permission by EDDC on 1st June 2004) the applicant has brought an appeal against an enforcement notice issued after this decision, whereby the applicant has made a material change to the former use of this area as grazing land. Written representations should be sent to; The Planning Inspectorate, 3/05b Kite Wing, Temple Quay House, 2 The Square, Temple Quay, Bristol BS1 6PN quoting reference APP/U1105/C/04/1150738 by 10th August 2004.

Windwhistle Farm - Appeal dismissed application 03/P0212 and enforcement notice upheld for agricultural dwelling. Also received copy of EDDC Enforcement letter confirming that the Enforcement Notice took effect on 22nd June 2004 and that they must cease residential use of the property and remove the mobile home from the land within two months of that date. (Failure to comply with an Enforcement Notice is an offence and prosecution can lead to a maximum £20,000 fine by the Magistrates Court).

113 Tower Way - Appeal dismissed for application 03/P2328 conservatory to rear of property.

2.4 Parish Plan - The finished plan has now been returned to Claire Rodway (EDDC) and will go to the meeting of the Executive next month with a recommendation for approval. Mrs Russell is to supply EDDC with further information on the consultations carried out and the number of people consulted. Although it is not now EDDC policy to adopt plans as Supplementary Planning Guidance, it will become an ’Approved Plan’.

2.5 EDDC - consultation on draft Supplementary Planning Guidance for affordable housing. Response by 20th August 2004. Mr Sworder is to respond once again suggesting the Blossom Hill site as suitable for affordable housing.

3 HIGHWAYS AND TRAFFIC
Meeting to confirm content of the Community Travel Plan (CTP) with Gary Powell 4pm Tuesday 13th July 2004. Clerk to check Mr Nicholsons apparent objection to the 40mph speed limit at Wolford Cross. Mr Powell is to order playground warning signs for the road approaching the Churchill Playground. The final draft of the CTP has since been received, and the new speed limits will be progressed shortly. Copies of the CTP will be placed on the notice boards with an explanatory note.

Clerks has received a response from Steve Tucker (Highways) who will inform Fulfords that they will now be charged for every sign that Highways remove. Grass cutting is now every six to eight weeks and weed spraying will take place in the next few weeks. The redundant cats eyes beside the entrance to Highwood Farm are to be removed. Clerk was asked to send a letter to Highways praising the work of our current Lengthsman (Mervyn).

4 FOOTPATHS AND BRIDLEWAYS
Report from Mr Barrow - The Head Footpaths Warden has now walked all paths in the parish and as extra funds exist for improvements some paths were marked as failing in order to allow funding for new gates and other improvements, although all paths were in generally in good order.

5 ENVIRONMENT
EDDC tree warden Tim Errington and his junior have both left, leaving the position on temporary cover by the Planning Department. Clerk has spoken to Cllr Boote and made a suggestion that Parish Tree Wardens could be given further responsibility in an advisory role as a trial measure. Both positions have been advertised but not filled.

6 COMMUNITY FACILITIES
6.1 Community policing report - PC Lea reported an unusually high level of reported crimes (21) between May and July 2004. This figure being almost half of last years total in just two months. It was noted that none were items stolen from sheds and so the recent initiative to mark property had worked well. Most crimes were unrelated, 1 was a ‘no crime‘, whilst there were 5 domestic incidents, 3 attempted burglaries, 1 incident at Brookside Farm (PC Lea is to contact Social Services to ask for better supervision of the youngsters), the theft of a mobile phone, two business deception, 2 thefts of mixers, 3 damage to property and 2 thefts of garden ornaments. One man was removed from Smeatharpe in preventing an illegal rave, but otherwise the 5 mile exclusion zone worked well.

6.2 Internet access - DCC are prepared to donate £1000 towards providing a local internet access point, The Fish Plaice has been approached and has agreed to the proposal and is interested in the proposal a letter with proposed costings has been returned to9 Sarah Duffin (DCC) and a cheque is awaited.

6.3 Playground safety inspections work required - remedial action is being taken by Mr Sumpter and Mr Howard at the Churchill Playground.

6.4 Dunkeswell Youth Club - Letter thanking the Parish Council for the use of the Community Hall for the coming year.
South West Airfields Trust - letter thanking the Parish Council for the donation towards D Day celebrations.

6.5 Blackdown Hills Rural Partnership - Blackdown Hills Bus Shelter Project - two parishes are sought to take part in a pilot project to replace any shabby glass and steel bus shelters with locally crafted wooden shelters funded through LEADER +. It was decided that all shelters in the Parish were of adequate repair at present.

7.2 EDDC Rural Aid 2004/5 £2,500 (of the £4000 requested) has been awarded to rebuild the back lobby of the hall and provide a cloak room/storage area, with an entrance ramp for disabled access.

8 CORRESPONDENCE
8.1 NHS Foundation Trust - letter offering a representative to attend on of the Parish Council meetings to give a presentation. Clerk to decline offer.

9 QUESTIONS FROM THE PUBLIC
The meeting to be adjourned for questions from the public.

Several members of the Public expressed concern over the possibility that WIMS may bulldoze a road way onto Abbey Road from Flightway. Mr Sumpter to make a site visit and investigate. Clerk to inform EDDC Enforcement of the rumour.

Mr Guest discussed the possibility of sending letters to several houses on Highfield asking that they pare their hedges back. It was resolved that Mr Guest would supply the clerk with a list and a letter would be issued.
