Minutes for a meeting of Dunkeswell Parish Council to be held in the Village Hall on Monday 20th June 2011 at 7.30pm.
Present: Cllrs John Barrow (Chairman), Geoffrey Sworder (Vice Chairman), Beth Russell, Donna Delamain, Brendan Procter, Andrew Luscombe, Philip Stevens, District Councillor Bob Buxton, PCSO Anning 30012 and five members of the public.
Apologies: Cllr Vanetta Keitch, County Councillor Paul Diviani, PC Vickery 4783.
All councillors are politely reminded of their obligation to declare interests under the Code of Conduct.
In making decisions the Parish Council recognise their statutory duties provided for in Section 11A(2) of the National Parks and Access to the Countryside Act 1949 (National Parks) and Section 85 of the Countryside and Rights of Way Act 2000 (AONBs) that in exercising or performing any functions in relation to, or so as to affect, land, they shall have regard to their purposes (ie conserve and enhance their natural beauty, wildlife and cultural heritage and to promote opportunities for the understanding and enjoyment of their special qualities by the public).

- Parish Plan – to receive the newly published parish plan- there will be a meeting with GNS, JB, BB, PD and Kate Little to discuss where we will go next with the parish plan. There is a possibility we might be labelled as a Vanguard area to build a Neighbourhood Plan.
- Old village of Dunkeswell Conservation Area Document – it was agreed at a full council meeting on 8th June 2011 to support the district councils proposal to designate the old village of Dunkeswell as a Conservation Area to preserve the way the village looks for the future. Original document attached. It was agreed to suggest an amended boundary to take in some additional areas which might affect the visual aspect of the village. Clerk to send amended map to EDDC. There were no additional amendments felt necessary to the document although there was some concern that properties should not be limited in their installation of solar thermal and photovoltaic panels.
- HIGHWAYS AND TRAFFIC
- To receive issues to report – drains outside police house are blocked with grass and rain is running right over. It was also asked that when the verges are cut that they ensure the grass does not clog the Percy Hill drains (or any others).
- Update on issues already reported: clerk to chase catseyes replacement and Percy Hill Drains again
- Gritting – A grant of £1000 has been received to enable the parish council to purchase a towed gritter, Cllr Barrow to advise on best option for purchase.
- Manleys Lane – a gentleman asked at the AGM when Manleys Lane was officially adopted – Highways have confirmed that Manleys Lane, Dunkeswell Ph 1 was adopted on 12 March 2011.
- EDDC - Following the Service Delivery and Performance Overview and Scrutiny Committee of 9 March 2011, a copy of a report on Farmers, fields & Land Drainage, an extract of the minutes of that meeting (see below) and Drainage Guidance Notes for Riparian Owners has been set to the council for our information.
- DCC Road Closure – Dunkeswell – Gypsy Cross, between 1900hrs and 0700hrs 29th June – 1st July 2011 for resurfacing (this closure is at night to cause minimal disruption, there will still be access fro residents.
FOOTPATHS AND BRIDLEWAYS
Report from Cllr Barrow – Most paths are strimmed, there has also been some clearance of branches.
ENVIRONMENT
Emergency Plan – nothing to report
COMMUNITY FACILITIES
- Community policing report – PCSO Anning – two crimes; one burglary via an insecure door while a resident went out of the back door to put recycling out suspicion is this is not a classic burglary, but may be known to the resident. The other crime is the theft of milkmans produce, the police do have a report that a red vehicle with a black roof has been seen at the time of the crimes and public are asked to take a number plate and report it immediately if they do see a crime being committed.
- Playgrounds/Sports field/ Allotments/halls – Cllr Sworder has had a request from the Allotment Association with several queries, all have been responded to. Play inspections received (for action) low risk items at new Century park are under review and items in Churchill playground are to be scheduled and quotes to be obtained. Sportsfield lease should complete shortly, although the parish council agreed for it to be signed by the clerk and chairman two years ago, Everys require confirmation that the parish council authorise the Clerk & GNS to sign the lease on behalf of the parish council – this was agreed.
FINANCE
- Funding –Throgmorton Hall – grant has been requested in the sum of £600 to install timers on light switches and a cupboard (estimate included detailing work), this will save energy and provide better facilities for the community. (Application form, accounts and constitution attached). It was agreed that considering the possibilities of additional expenses this year for the parish council that this might not be possible this year. The hall might decide what is completely necessary and also seek alternative funding.
- Insurance – to review cover and formally accept renewal quote from Community First Insurance (together with decision to self-insure any assets not covered by the main policy) (email copy attached)

7.5 Bank signatory forms for completion – in the event that signatories change after the election clerk is asking for change of signatory form to be completed.
7.7 Power of Wellbeing - council to determine its own eligibility by resolution at a full council meeting, eligibility remains until the day before the annual general meeting after the next ordinary elections (up to four years).
Criteria:
- Two-thirds seats filled by candidates who stood at last ordinary elections.
- Qualified clerk - including CiLCA 2008 (s7).
- 80% of the members trained in Power of Well-being.
- Published a Statement of Intent for Community Engagement. Eligibility Agreed
- EDDC new appointments; on 25 May 2011, Cllr Peter Halse was appointed as Chairman of East
Devon District Council. The Vice Chairman is now Cllr Frances Newth. Cllr Paul Diviani was appointed as Leader of EDDC at the Annual Council on 25 May. His Deputy Leader will be Cllr Andrew Moulding
- Devon Association of Local Councils Committee Election 2011 – vote agreed.
7.10 EDDC Review of Polling Stations and Places – views sought on the location and facilities of the current station – clerk to tell EDDC that the Hall is very well equipped and completely suitable. For agreement
QUESTIONS FROM THE PUBLIC (The meeting to be closed before questions from the public).
A gentleman asked who should take farm mud off the road, it was confirmed that it was the responsibility of the farmer.
It was raised by several parish councillors that a parishioner has been seen on more than one occasion wearing her yellow high visibility jacket collecting litter around the parish. She was commended for her action and the clerk is to write a letter of thanks, it was discussed that it would be greatly beneficial to us all if we could all take care of our environment a little.
