DUNKESWELL PARISH COUNCIL

Minutes for a Meeting of Dunkeswell Parish Council held in the Village Hall at 7.30pm, Monday 17th November 2008.

Present:            Mr G Sworder (Chairman), Mr J Barrow (Vice Chairman), Cllrs Mrs B Russell and Mrs V Keitch,
Mssrs Mr C Sumpter ,M Stevens, B Procter, A Luscombe,
District Councillor Mr Bob Buxton, PCSO Anning 30012 and no members of the public.

All councillors are politely reminded of their obligation to declare interests under the Code of Conduct.
In making decisions the Parish Council recognise their statutory duties provided for in Section 11A(2) of the National Parks and Access to the Countryside Act 1949 (National Parks) and Section 85 of the Countryside and Rights of Way Act 2000 (AONBs) that in exercising or performing any functions in relation to, or so as to affect, land, they shall have regard to their purposes (ie conserve and enhance their natural beauty, wildlife and cultural heritage and to promote opportunities for the understanding and enjoyment of their special qualities by the public).
1            Minutes of the previous meeting held in the Village Hall on Monday 20th October 2008 were signed as a correct record of that meeting.AGREED
2            PLANNING

    1. Decisions (for information)
      1. 08/2024/FUL Unit 2, Flightway – Permission refused for siting of six storage containers/residential mobile

2.2            Applications (for comment)
2.2.1            08/2643/FUL Little Turbury, Long Lane – retention of garage Comments: no objections.
2.3        Tree Applications (for decision) none
2.4        Parish Plan - Update ideas are to be discussed at the next meeting when we expect a visit from a representative of Community Council of Devon..
2.5            Mansell Raceway – update; hearing of the appeal inquiry against the noise abatement order has now closed and a decision will be announced on 19th December 2008. World Health Organisation guidelines say above 50dB you will get complaints, above 55dB you will certainly have complaints.  It is not just the decibel level it is also a health and welfare issue through stress caused by the nuisance.  It was also deemed that an increase of noise of 10dB would lead to complaints and that a screeching noise of only 5dB increase could be a nuisance. The noise abatement order can be struck out, agreed as it is or in a modified form by the judge when he returns a verdict.

    1.          Smeatharpe - Appeal has been made against the noise abatement order has been made and will be heard in  

               February 2009.

    1.           Ministry of Defence sale of Airfield Land under Crichel Down Rules - EDDC has expressed an interest in  

            purchasing the land within the perimeter road and the two listed buildings. EDDC are also looking at designating 
the site as a Conservation Area to protect the historic airfield and buildings. An Article 4 Direction may be imposed on the Blackdown Hills as a whole, this would remove permitted development right and so mean all planning issues would  require applications.

    1.       The application for tyre and other reprocessing at Westerhope is expected to be refused by the County Council 

            and we understand that this activity has already ceased.

3            HIGHWAYS AND TRAFFIC
3.1        Parish lengthsman programme received for information October 2008-March 2009.
3.2            Signage requested – Manleys Lane already bears a no though road symbol on the road sign. A sign for the
Airfield could be placed at Chapel Cross is required, DCC feel that there are already too many signs at Wolford Cross and Dunkeswell is signed still at that point, however a further sign can be placed where it would be of most benefit. If there are any particular Satellite navigation system issues in the village these can be reported to DCC Highways who work with the mapping companies to correct these issues. Meeting to be requested to discuss what signage is possible
4            FOOTPATHS AND BRIDLEWAYS
4.1        Mr Barrow reported that there was much damage to footpaths and bridleways during the recent flooding, most of             which has been repaired already, there is some work yet to be completed, but these are tasks in conjunction with      DCC.

6            COMMUNITY FACILITIES   

    1. Hastoe Housing have advised that the vacancy at 15 Manleys Lane has now been filled.
    2. Community policing report – PC Vickery/PCSO Anning - three crimes: theft of three headed multi cutter stolen from yard, one burglary of quad bike and chainsaw from barn and an arson caused by a juvenile causing damage to bedding and clothing. Mr Sworder asked about seeing the results of a black box radar that was recently in the village, this was detecting speeds.
    3. Playgrounds/Sports field/ Allotments – EDDC contract for MUGA Surface has been received. The sports field is now to be leased to the Parish Council for 28 years and not transferred. The map does not include the allotments, so it is not known as yet if they will be offered a direct lease. The Allotment Association has vacancies on its committee. The BMX track is also in need of repair, it was agreed for budgeting purposes that this should be done approximately four times a year and grass cut monthly.          
    4. Halls – All users of the old hall are moving to the new hall and Mr Throgmorton has agreed that the Parish Council cabinets can move to the disabled toilets in the old hall. It was also agreed that the old hall account should be shut and the balance donated to the Youth Club, as well as that the Youth Club hall rental should continue to be paid by the Parish Council for the financial year 2009-10.

7.3            Communities in Control – consultation document from Communities and Local Government office. Views requested by 24th December 2008. Agreed that there were no contentious proposals in the document so no response was necessary.
7.4        Land Registry Office – land to be registered - deeds have been located at Everys and the land is to be registered.
7.5            Precept – special items for consideration in 2009/10 budget to be tabled at the next meeting.
7.6            BLACKDOWN HILLS PARISH NETWORK MEETING - Monday 1st December 2008, 7.30pm at Churchinford Village Hall, councillors - please attend if possible. A DCC officer will be attending to discuss the trial of elements of the Community Board idea.
7.7            Honiton Town Council meeting with local parishes – Tuesday 9th December 2008 – 7pm at Honiton Town Council Chambers, to discuss the Boundary proposals, LDF and Communities in Control White Paper. No one will be attending from Dunkeswell.
