Minutes for the Meeting of Dunkeswell Parish Council held in the Village Hall at 7.30pm, Monday 20th September, 2004.
Present: Mr G Sworder (Chairman), Mr A Guest (Vice Chairman),
Mrs B Russell, Messrs J Barrow, C Sumpter,
M Stevens, B Procter, A Luscombe, District Councillor Mrs M Boote and six members
of the public.
Apologies: County Councillor Mr B Nicholson and PC Lea
1 Minutes of the previous meeting held in the Village Hall on Monday 16th August,
2004 were signed as a correct record of that meeting proposed by Mrs Russell,
seconded by Mr Procter and unanimously agreed.
2 PLANNING
2.1 EDDC Decisions
04/P1189 Units 13.14 and 18b - 18j Flightway - Permission refused for live/work
units.
04/P1528 9 Powell's Way - Permission granted to demolish one of two garages/build
bungalow.
04/P1488 10 Culme Way - permission granted for PVCU Conservatory.
04/P1744 Nr Slade Farm - Permission granted for installation of temporary generator.
04/P1214 Fishponds House - Permission granted for Marquee change of condition

Applications
2.2.1 04/P0078 British Light Aircraft Co. Ltd. - change of use - hangar from
storage to assembly of aircraft/ extensions/alterations. Copy letter Thomas
Designs to EDDC confirming that the site will be served by one lorry fortnightly,
then weekly in future. The scrap metal business currently conducted there attracts
two articulated lorries per day. Aircrafts will be flown from the site for delivery,
thereby generating no traffic. It is hoped to employ 100 local people and ten
to twenty experts as management. The site would be open 8am - 6pm five days
per week. As no proposals predicting mass of traffic flow have been forthcoming,
it was felt that the effect of increased traffic through the village outweighed
the possibility of creating new jobs (by the grant of this permission no guarantee
was offered that these jobs would exist, nor that this firm would decide to
take the premises, the fear being that a business of a similar size, but with
more environmental impact could then make a similar application). In addition
Highways had offered an unsuitable suggestion for a public footpath funded as
part of this application. Proposed for refusal from the Chair, seconded by Mr
Luscombe and unanimously agreed.
2.2.2 04/P0484 Dunkeswell Kart Racing Club - formation of extended
track. Mr Sworder, Mrs Napier, Mr Wood (both of Sheldon) attended a meeting
with Mr Thomas, Mrs Little and Mr Milverton of EDDC to further discuss this
proposal. Both Sheldons independent survey and EDDCs survey are now being studied
by EDDC. A number of the promises made in Mrs Littles recent letter had been
carried out, but noise surveys have still not been taken from Sheldon. It is
still to be decided whether extending the track will increase noise levels (it
is agreed that it will not reduce them). The application will not be turned
down unless it is proved that noise will increase. It must be remembered that
noise restrictions only apply to races and not sprints or practices. Mr Boote
sympathises with Sheldon, but reminded the meeting that the site has permission
and it is not a planning issue to do anything about the current position. Mr
Sworder agreed that the only current argument would be that noise levels on
the track have over the years worsened, and therefore may be measurable as a
statutory nuisance, which has not as yet been assessed by Environmental health.
No decision has yet been reached – EDDCs comments on the results of all
reports are awaited.
2.2.3 04/P1221 WIMS (UK) Ltd., Culme Way - 30 residential units, parking, community
facilities, extension to doctors surgery and pavilion. As no meeting has been
arranged to discuss proposed amendments to the scheme, it was proposed by Mr
Sumpter to refuse this application in all grounds as stated to WIMS and EDDC
previously and await a new scheme. This was seconded by Mr Barrow and unanimously
agreed.
Due to EDDC time restrictions the following three applications
have been returned prior to the meeting with no objection (proposed by Mr Sumpter,
seconded by Mrs Russell and unanimously agreed:
2.2.4 04/P2026 RH & DV Dymond, Land at Turbury (Luppitt and Awliscombe)-
farm building. (There has since been a complaint from neighbours whose property
is not shown on the site plan. They are to make their objections to EDDC directly).
2.2.5 04/P2051 M Kendrick and D Allison, The Royal Oak - two storey thatched
house with garage
(amended design 03/P2490).
2.2.6 04/P2094 Mr and Mrs Cave, old Highwood Bungalow - extension of existing
detached garage for carport.
2.2.7 04/T0064 Mr Harmes, 56 Louis Way – Fell one ash tree. Proposed for approval by Mr Barrow, seconded by Mr Guest and unanimously agreed.
The following three applications were proposed for refusal by
the Chair, seconded by Mr Barrow and unanimously agreed, on the grounds that
this represents excessive domestic development on industrial land, which is
not needed. Additionally, the current sewage system would be overloaded by such
a large scale housing development and there are inherent dangers of introducing
family housing to industrial areas.
2.2.8 04/P2293 WIMS (UK) Ltd. Units 13.14 & 15 Flightway - Amendments to
include Living accommodation & construct live /work unit to plot 15.
2.2.9 04/P2348 WIMS (UK) Ltd. Units 18a to 18g Flightway – development
of live/work units.
2.2.10 04/P2346 WIMS (UK) Ltd. Units 18h and 181 Flightway – development
of live/work units.
2.2.11 04/P2330 Plus One Residential and Foster Care, Brookside farm – extension to outbuilding to form training room and siting of wooden hut for storage. Planning Committee to visit site, speak to PC Lea and make recommendation.
2.3 Parish Plan – EDDC letter confirming that the council
has ratified the plan, thanking the Parish Council for its efforts and confirming
that this will form part of the ‘consultative’ information that
feeds into the Community Plan for East Devon. The full plan is to be circulated
in the Parish Magazine and put on the Parish Councils website.
2.4 Application for transfer of Justices Licence to Mr M G & Mrs F Perkins
was held at The Court House, Exeter 14th September 2004
2.5 ENFORCEMENT –
Clerk has spoken to Enforcement who have confirmed that the bank removal at
Tower Way was authorised as Permitted Development by EDDC prior to works and
the wall is under 1 metre high. Further information is still awaited regarding
the new track at Blossom Hill and Ball Knapp fence. Clerk to contact Enforcement
and reaffirm that there should be no vehicular or pedestrian access to Abbey
Road from Flightway, there is only permission for a cycle path (this should
only then be implemented when the entire track is built).

3 HIGHWAYS AND TRAFFIC
Clerk has spoken to Stephen Tucker of Highways regarding several issues:
Manley’s Lane adoption by Highways – As we know this can only be
done when the developer has brought the road to a standard acceptable by Highways.
Highways can invoke action to force developer to complete the road for adoption
now development has finished. (Clerk to check with John Bowden as to progress
in this matter).
Fulfords Signs – Fulfords are ignoring Highways requests to stop placing
illegal signs advertising new homes – any found are being removed by clerk
or Highways. Highways may only charge Fulfords to give them back; Fulfords aren’t
bothered as they are disposable. The Village may wish to co-operate in removing
them wherever they appear, we may wear them down!
Chapel Hill resurfacing - This is still in the schedule, but due to mid year
budget cuts it has not yet been done. Clerk was assured that if it is not completed
in this financial year it will be first on the list for the next.
Chapel Hill land ownership – Highways search from Land Registry was ‘inconclusive’
so no owner has been found for the verge to the Chapel side.
Clerk to write to Tony Matthews/Gary Powell and reinforce the case for a footpath
link as the dark nights are drawing in, ask about signs to warn drivers there
are pedestrians/no footpaths and also ask again about school bus pick up points.
4 FOOTPATHS AND BRIDLEWAYS
Mr Barrow reported that several new gates have been delivered and there are
more to follow.
5 ENVIRONMENT
Mr Sworder reported that the sewer by the bridge had recently been blocked,
efforts to unblock them had resulted in a long length of rods being disconnected
and lost. South West Water are to return to try and locate these shortly.
6 COMMUNITY FACILITIES
6.1 Community policing report – (Supplied by PC Lea) – There were
8 reported crimes in the last month; damage to the Memorial Museum window, two
mail order catalogue frauds, one assault (suspect known), damage to the Gate
of the Old Police House, a burglary at Hall Engineering (cash stolen), a car
stolen and recovered and theft of a mobile phone.
6.2 Internet access – Telephone line, chair and computer are ready, cabinet
is still awaited for installation to take place.
6.3 Playground safety inspections – The Churchill Playground fence is
now being replaced, Mrs Russell has been looking for quotes to replace the wood
chips with a grass mat system (best so far £5,300).
6.4 Clerk to send letters of thanks to Mr Wilson-Webb and Mr Howard for renovating
the bench at Percy Cross.

8 CORRESPONDENCE
EDDC Draft Community Plan for East Devon – comments requested by end of
September 2004.
9 QUESTIONS FROM THE PUBLIC (The meeting was adjourned for questions
from the public).
Mrs Gorman asked whether a member of the Parish Council would like to attend
the Pre-School AGM on Wednesday 29th September 2004 at 7.30pm (Mrs Russell to
attend). Also whether a visit to the Luncheon Club would be possible (Mr Sworder
to visit on 20th October 2004).
